2. Description of Service

Planovel provides AI-powered design and architecture software tools, including but not limited to:

Automated design generation and optimization
3D modeling and visualization tools
Project management and collaboration features
Integration with third-party design software
Cloud-based storage and processing services

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

You retain ownership of all content you upload, create, or generate using the Service ("Your Content"). By using the Service, you grant Planovel a limited, non-exclusive, royalty-free license to:

Store, process, and display Your Content to provide the Service
Create backups and ensure data security
Improve our AI models and algorithms (in anonymized form)

5.2 Planovel's Intellectual Property

Planovel owns all rights, title, and interest in the Service, including but not limited to:

Software, algorithms, and AI models
Trademarks, logos, and brand elements
Documentation and user interfaces
Proprietary technology and know-how

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with applicable data protection laws, including the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 of India.

7. Service Availability and Modifications

7.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes that may affect your use of the Service.

8. Subscription and Payment Terms

8.2 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis
All fees are non-refundable except as required by law
We may change pricing with 30 days' notice
Failure to pay may result in service suspension

8.3 Free Trial

We may offer free trials of our Service. Free trials are subject to these Terms and may be limited in features or duration.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANOVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL PLANOVEL'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Planovel, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your Content or its use

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in your account settings.

11.2 Termination by Planovel

We may terminate or suspend your account immediately if you violate these Terms or engage in conduct that we determine is harmful to our business or other users.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data after a reasonable period, subject to our data retention policies.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India. The arbitration shall be conducted in English in Mumbai, India.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Planovel regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both parties.

13.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
